Terms of service
These terms are between Genius Learning, Inc. (“we”) and the school or organization that uses Placement Genius(“the school”). A staff member who creates an account, starts a pilot or makes a purchase accepts them on the school's behalf and confirms they are authorized to do so. Students and parents do not accept these terms; their information is covered by our privacy policy and the school data agreement.
1.The service
Placement Genius gives schools placement tests for applicants and diagnostic screenings for enrolled students, currently for grades 3 to 8 in math and language arts, with reports in the language of the school's curriculum.
A recommendation, not a decision. Reports describe what a student showed on one sitting. The school makes every admission, placement and instructional decision, and is responsible for them. The service does not diagnose any learning disability or other condition, and a flag that suggests a conversation about a professional evaluation is not a diagnosis.
2.Student information
The school owns its student records. We handle them only as the school data agreement and our privacy policy describe: for the school's educational purpose, never sold, never used for advertising, and never combined with other schools' information. If anything in these terms conflicts with the school data agreement, the agreement governs.
We provide the parent notice and the consent line the agreement describes; the school shares them with families, tests at school with staff present, and keeps the information its staff enter accurate. Our own duties to protect children's information stay ours.
3.Accounts
Only school staff have accounts; students never do. The school controls who has access and at what role, keeps sign-in details confidential, and tells us promptly about any unauthorized use. Each account is for one person.
4.What each plan covers
- Placement covers applicants and incoming transfer students the school is considering for admission.
- Diagnostic covers students already enrolled at the school. Testing an enrolled student requires Diagnostic, either as an add-on or per screening; a Placement plan does not cover it.
- Annual plans run 12 months from payment and do not renew automatically. Per-test and per-screening credits expire 12 months after purchase. A retest offered by the service does not use a credit.
We may limit or pause use that falls outside a plan (for example, testing enrolled students under a Placement plan, or creating applicants in a volume no admissions process would), after telling the school and giving it a chance to choose the right plan.
5.Fees
Prices are listed on our pricing page or in the school's written order or pilot agreement. Payments are one-time and processed by our payment provider. Taxes, if any, are the school's. Refunds. A purchase is fully refunded if the school asks within 30 days of purchase and no test has been started under it. After that, annual plans are not refundable. Unused per-test or per-screening credits are not refunded, but they stay valid for 12 months from purchase.
6.Acceptable use
The school will not: share accounts; let anyone outside the school use the service; copy, publish or teach to the test questions; try to see answer keys or other schools' information; reverse engineer, scrape or disrupt the service; or use it in violation of law. Test questions are confidential so that results stay meaningful for every school.
7.Ownership
We own the service, its software, test questions, curriculum maps and written content. The school owns its student records and may print, keep and share its reports for its own purposes. Placement Genius is not affiliated with or endorsed by Abeka, BJU Press, Saxon or any curriculum publisher; curriculum maps reference publishers' publicly available scope and sequence.
8.Warranty disclaimer
We work to keep the service accurate and available, but it is provided “as is.” To the extent the law allows, we disclaim implied warranties, including merchantability and fitness for a particular purpose, and we do not promise that any placement, recommendation or result is correct for a particular student.
9.Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, and our total liability under these terms is limited to the fees the school paid us in the 12 months before the claim. These limits do not apply to our obligations to protect student information under the school data agreement, or to either party's fraud or willful misconduct.
10.Ending service
The school may stop using the service at any time. We may suspend or end access for a material breach of these terms that is not cured within 30 days of notice, or immediately where needed to protect students or the service. When service ends, we export the school's reports on request and delete its student information as the school data agreement provides.
11.Changes
We may update these terms. We tell schools about material changes at least 30 days before they take effect; continuing to use the service after that means the school accepts them. Changes that affect children's information follow the privacy policy and the school data agreement.
12.Law and contact
These terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws rules. Questions: Genius Learning, Inc. · 303 Loganwood Ct., Joppa, MD 21085 · support@electivegenius.com.
